These Terms of Service ("Terms") apply to flagshipgrowth.com (the "Site") and to Flagship Insights, the analytics app at insights.flagshipgrowth.com (the "App"), both operated by Flagship Growth ("Flagship Growth," "we," "us," or "our"). By using the Site or the App you agree to these Terms. If you use the App on behalf of a company, you agree to them for that company. If you have a signed services agreement with us, that agreement controls wherever it conflicts with these Terms.
1. The App
Flagship Insights shows a brand's own Amazon sales, search, inventory, listing and pricing data, together with reports and recommendations. It is described on the Flagship Insights page. Access is by invitation, and each user needs their own login.
2. Your account
You are responsible for the people you invite, for keeping login details confidential, and for activity under your logins. Tell us right away at joey@flagshipgrowth.com if you think an account has been misused. We may suspend a login to protect your data or the App.
3. Connecting your Amazon account
You may authorize the App to access your Amazon Seller Central account through Amazon's own authorization process. You confirm that you have the authority to give that permission. The App only reads data; it does not make changes in your Amazon account. You can revoke the App's access at any time in Seller Central under Apps and Services → Manage Your Apps. Your use of Amazon's services remains subject to your own agreements with Amazon.
4. Your data
You own the data from your accounts and anything you enter into the App. You give us permission to process it only to run the App and the services you have engaged us for. We handle it as described in our Privacy Policy. In particular, we never sell it, never combine it with other sellers' data, and delete Amazon data within 30 days after you revoke access or your account ends, unless the law requires us to keep a specific record.
5. Acceptable use
You agree not to: share your login with anyone else; try to access another brand's data or any part of the App you have not been given; probe, scan or test the App's security without our written permission; interfere with the App's operation; copy or resell the App; or use the App in a way that breaks the law or Amazon's policies.
6. Fees
The App is included at no extra cost with a Flagship Growth management plan. Management plans, and any standalone access to the App, are priced in a written quote or agreement. We will not charge you for the App without a signed agreement.
7. Recommendations
Reports and recommendations are based on the data available to the App and are given to help you decide. They are not guarantees of results. Decisions about your listings, pricing, inventory and advertising remain yours.
8. Availability and changes
We work to keep the App available and accurate, but it may sometimes be unavailable for maintenance or because of problems with services we rely on, including Amazon's. We may improve or change features over time. If we make a change that materially reduces what the App does for you, we will tell you in advance.
9. Ending access
You can stop using the App at any time by revoking access in Seller Central and telling us. We may end or suspend access if these Terms are broken, if your services agreement ends, or if Amazon requires it. When access ends, we delete your Amazon data as described in section 4.
10. Our content
The Site and the App, including their design, text and software, belong to Flagship Growth. Case studies and articles on the Site are for information only.
11. Disclaimers and liability
Except as stated in a signed agreement, the Site and the App are provided "as is" and "as available," without warranties of any kind, to the extent the law allows. To the extent the law allows, Flagship Growth is not liable for indirect, incidental or consequential losses, or for lost profits or sales, arising from use of the Site or the App, and our total liability relating to the App is limited to the amount you paid us for it in the twelve months before the claim.
12. Trademarks
Amazon, Seller Central and Brand Registry are trademarks of Amazon.com, Inc. or its affiliates. Flagship Insights is an independent app made by Flagship Growth and is not made, sponsored or endorsed by Amazon.
13. Changes to these Terms
We may update these Terms. The date at the top shows the latest version. For material changes we will notify App users by email before they take effect.
